1. Terms

By accessing our website at https://hankinsoft.com (the "Site") or by downloading, installing, or using any of our software applications, products, or services (collectively, the "Products"), you are agreeing to be bound by these Terms of Service and our Privacy Policy, all applicable laws, and regulations. You agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing our Site and Products. The materials and software contained within our Site and Products are protected by applicable copyright, trademark, and intellectual property law.

2. Definitions

  1. "Services" refers collectively to the Site and the Products.

    2. Download, install, and use one copy of a Product on devices you own or control, solely for your personal, non-commercial use, in accordance with any specific product license agreement that may accompany the Product.

    1. modify, copy, or create derivative works of the Content;
    2. use the Content for any commercial purpose, or for any public display (commercial or non-commercial);
    3. attempt to decompile, reverse engineer, or disassemble any software contained in the Services;
    4. remove any copyright or other proprietary notations from the Content;
    5. transfer the Content to another person or "mirror" it on any other server; or
    6. circumvent or attempt to circumvent any copy protection, digital rights management, or licensing features within the Products.
  3. Termination. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Hankinsoft Development, Inc. at any time. Upon termination, you must destroy any downloaded Content in your possession, whether in electronic or printed format, and uninstall all Products.

4. Products

  1. Product Licensing. Some Products may be accompanied by a separate End User License Agreement (EULA). In the event of a conflict between these Terms and a specific EULA, the terms of the EULA shall prevail for that Product.
  2. Updates and Support. Hankinsoft Development, Inc. may, at its sole discretion, provide updates, bug fixes, or other support for its Products. You agree that we are not obligated to provide any ongoing support or specific updates. We may add or modify features, or discontinue a Product at any time.
  3. Third-Party Components. Some Products may include software or libraries licensed from third parties. Such components are subject to their own respective licenses.

5. Disclaimer

  1. The Services and all Content are provided on an 'AS IS' and 'AS AVAILABLE' basis. Hankinsoft Development, Inc. makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
  2. Further, Hankinsoft Development, Inc. does not warrant or make any representations concerning the accuracy, likely results, reliability, or security of the Services or the Content thereon, or on any sites linked to the Site. Hankinsoft Development, Inc. does not guarantee that the Products or Services will be error-free, uninterrupted, or free from harmful components.

6. Limitations

In no event shall Hankinsoft Development, Inc., its directors, employees, or suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption, or personal injury) arising out of the use or inability to use the Services, even if Hankinsoft Development, Inc. or an authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

7. Accuracy of Materials

The materials and information appearing on the Services could include technical, typographical, or photographic errors. Hankinsoft Development, Inc. does not warrant that any of the materials on its Services are accurate, complete, or current. Hankinsoft Development, Inc. may make changes to the materials contained on its Services at any time without notice. However, Hankinsoft Development, Inc. does not make any commitment to update the materials.

8. Links

Hankinsoft Development, Inc. has not reviewed all of the sites linked to its Services and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Hankinsoft Development, Inc. of the site. Use of any such linked website is at the user's own risk.

9. Modifications

10. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Canada, and you irrevocably submit to the exclusive jurisdiction of the courts located within Canada.
